Dear CCSD 46 Community,
I am writing today to address safety questions that have come to us.
We have heard reports of the presence of Immigration and Customs Enforcement (ICE) agents in or around our community today. Perhaps you have heard of this, too. Please know that despite what you may have heard, there is no evidence that ICE agents have been on school grounds at any K-12 schools in our area. However, in the event that ICE agents were to come to our schools, we have protocols in place to ensure the safety and privacy of our students and staff. Procedures include information about who a staff member should contact and what information to collect from the ICE agents. ICE agents would not be allowed past our offices. Also, if ICE agents were to come to our grounds, we would keep all students inside the school building.

Community members, the intent of today’s message is to make sure that you know that we have thought carefully about how to provide safety for our students and staff, and to let you know that ICE agents have not entered K-12 school grounds. As stated in the message below: At CCSD 46, we want to reassure our families that our schools are safe, welcoming spaces for every child. If there is more information regarding schools to share in the future, I assure you that we will provide it.

At CCSD 46, we want to reassure our families that our schools are safe, welcoming spaces for every child. We recognize that recent reports of increased Immigration and Customs Enforcement (ICE) activity in the Chicagoland area may cause worry for some of our students and families. Please know that all children—regardless of immigration status—have the right to a public education, and our district is committed to protecting their access to learning. We do not collect or share information about immigration status, and student records are strictly protected by law. If immigration officials ever request access to a student, our administrators will follow all legal requirements to safeguard the rights and privacy of our students and families.
Most importantly, we want our immigrant families to feel cared for and supported. You are a vital part of our community, and we will continue to stand by you with compassion, respect, and resources to ensure your children’s success and well-being.
In the United States, all children are entitled to equal access to a basic public elementary and secondary education, regardless of their actual or perceived immigration status, or the status of their parents/guardians. This standard has been upheld by the U.S. Supreme Court in Plyler v. Doe, even in instances where a student may be undocumented. It is essential to note that a student’s attendance at school does not constitute a violation of the law, regardless of their immigration status. Additionally, schools are not permitted to track a student’s or parent’s citizenship status or inquire about such status. Student records remain protected by the Family Educational Rights and Privacy Act (FERPA). In compliance with state and federal law, CCSD 46 will continue to prioritize individual student rights and privacy if a law enforcement official requests to interview students at school.
If Immigration and Customs Enforcement (ICE) agents were to come to a school to interview a student, school officials would adhere to federal and state student privacy laws. The student would not be made available for an interview without required parental consent in accordance with the Family Educational Rights and Privacy Act (FERPA) and the Illinois School Student Records Act (ISSRA), nor without a signed judicial warrant or other required court order. School officials would refer the issue directly to one of several district office administrators, who would review the matter with the district’s legal counsel. The district does not request or retain information regarding the immigration/documented status of students or their family members. Furthermore, students and families are not required to provide Social Security numbers for school forms.
To ensure that the district can contact parents or guardians promptly, families should review their children’s profiles in Infinite Campus to ensure that the emergency contact lists are complete and up to date.
